This post is to explain the issues raised in the lawyer complaint post (search “lawyer complaint” on neighborly)
The HB law society(Standards Committee) has the right to ignore, disregard or withhold any evidence a client has submitted to them. This includes Witnesses, audio recordings and any other evidence.
The Act that allows them to do this is the Lawyers and Conveyancers Act 2006 = Section 151(1) =
If the HB Standards Committee decide to go over to the dark side ,as it appears in this case. There is nothing a victim can do except apply to the Lawyers Complaint Review Officer .Note: it may take up to 2 years to hear your case and if fraud is involved your money could be long gone.

Lawyers and Conveyancers Act 2006
Section 151(1) of the Act says:
“A Standards Committee may receive in evidence any statement, document, information, or matter that may in its opinion assist it to deal effectively with the matters before it, whether or not the statement, document, information, or matter would be admissible in a court of law.” (The emphasis has been added.)
On this basis, any evidence, including voice recordings are provided to the Standards Committee, and it is for the Committee to determine whether it will receive it, and if so, how much weight it will give to the evidence based on the information before it. Once a Standards Committee makes a decision on a complaint, and if the parties are not satisfied, it can be reviewed by the Lawyers Complaints Review Officer, which is an independent review body.
Thank you for your email. I trust this assists you to understand how a recording may be considered in complaints lodged with the Law Society.

Hi there,
I'm after someone who is handy at doing a few touch ups on my car. Getting ready to sell my car so need to tidy it up without spending huge amounts on it.
Anyone keen to give it a nudge for a cash job or suggestions welcome.
Thank you.
